Judicial Immunity: Two prong test

As the law stands, there is no “absolute judicial immunity” and our Supreme Court requires the two-prong tests:

1. Does the court have subject matter jurisdiction;
2. Is the act a judicial act.

Then and only then, according to Mireles (1991) does judicial immunity apply.
